Your Excellency Mr.
Torbjorn Jagland!
With due deep respect and
reverence! I am writing to you on behalf of the many hundreds Ukrainian
citizens who penned their signatures on this letter. We, the citizens of
Ukraine, standing on active civilian position are concerned that Ukraine is not
complying with resolutions 1549 (2007) and 1755 (2010) of the Parliamentary
Assembly of the Council of Europe "The functioning of democratic
institutions in Ukraine".
The present
Ukrainian voting system of closed-list proportional representation promotes
corruption, political and economic crisis in the country.
Today, neither the
President nor the Verkhovna Rada (Supreme Council) of Ukraine nor the Cabinet
of Ministers of Ukraine made the changes in the legislation of Ukraine on
elections of Parliamentarians and members of Local Governments from close list
single-member constituency to open lists multi-member constituencies, so that
voters themselves can nominate candidates for the Verkhovna Rada and Local
Governments. In 2012, the Parliament of Ukraine made some
changes in the voting-related legislation. Unfortunately, only 50 percent of
the recommendations of Resolutions 1549 (2007) and 1755 (2010) of the
Parliamentary Assembly were implemented. This continues to negatively affect
the operation of the Verkhovna Rada of Ukraine and Local Governments and this
was one of the reasons that led to the “Maidan” revolution and the mishandling
of Government institutions, capture of Crimea and the military operations in
the eastern part of Ukraine.
The 50 per cent
implementation of Resolutions 1549 (2007) and 1755 (2010) of the Parliamentary
Assembly of the Council of Europe has negative impact on the economic and
political situation in Ukraine.
These issues were
included in the comments of ex-Speaker of the Verkhovna Rada of Ukraine,
Vladimir Lytvyn, in the newspaper "Facts" of 22.11.2008 years, and
also in the comments of the Parliamentarian of Ukraine 2 - 4 convocation,
honorary member of the Parliamentary Assembly of the European Council, Anatoly
Rahanskiy in newspaper "Maidan" of May 2014 (see an attachment).
Putting in
consideration aforementioned facts, we appeal:
That you assist in Ukraine's implementation of
Resolutions 1549 (2007) and 1755 (2010) of the Parliamentary Assembly of the
Council of Europe as regards changes in the legislation of Ukraine on the
elections of Parliamentarians and members of Local Governments under open lists
proportional representation in accordance with European standards and the
resolutions of the Parliamentary Assembly of the Council of Europe.
Otherwise,
Parliamentary Assembly of the Council of Europe should impose sanctions against
Ukraine for failing to implement these resolutions:
- Deprive Ukrainian
delegation to the Parliamentary Assembly of the Council of Europe the right to
vote as members;
- Deprive Ukrainian
delegation the right to be elected into governing bodies of the Parliamentary
Assembly of the Council of Europe;
- Exclusion of
Ukraine from the Council of Europe.
These sanctions are
not favorable for our country, which is in a complex of critical political and
economic situation. We are appealing that in the forthcoming PACE January
session of the Parliamentary Assembly of the Council of Europe (2017) to
discuss "Functioning of democratic institutions in Ukraine”, make
resolutions encouraging Ukrainian leadership and the Verkhovna Rada of Ukraine
in the shortest possible time to implement resolutions 1549 (2007) and 1755
(2010) of the Parliamentary Assembly of the Council of Europe, because in
Ukraine there is the possibility of early parliamentary elections.
